Mumbai : A month after he was sentenced to life imprisonment by a lower court, Pravin Mahajan, accused of murdering his brother and Bharatiya Janata Party (BJP) leader Pramod Mahajan, has challenged his conviction at the Bombay High Court.
Pravin Thursday filed an appeal before the high court challenging the lower court’s order and the evidence on the basis of which he was convicted.
Pravin’s lawyer Mukesh Modi told IANS: “The threatening SMS, statements of eyewitnesses and the dying declaration of Pramod were wrongly accepted by the sessions court.”
Sessions Judge S.P. Dawre had accepted the threatening SMS sent by Pravin to his brother a few days prior to the murder as prime evidence.
On April 22, 2006, Pravin had visited Pramod’s residence at Worli in South Mumbai and had pumped multiple bullets into his elder brother in a fit of rage.
On May 3, Pramod Mahajan succumbed to his injuries in a city hospital.
The reason for the gory incident is speculated to be Pravin’s monetary problems with his brother.
Earlier, Pravin’s lawyers had in the sessions court demonstrated how the SMS could have been doctored.
Modi added that the appeal filed in the high court challenges the SMS message taken as prime evidence since it was clearly doctored.
“The appeal has been filed but has not yet been assigned a filing number, and once it is done, the hearing will commence the next week,” Modi said.
