Kolkata : The Calcutta High Court Friday fixed April 18 as the final hearing date in the perjury case filed by former Board of Control for Cricket in India (BCCI) chief Jagmohan Dalmiya against top board officials like Sharad Pawar and Ratnakar Shetty.
Justice Nadira Patherya of the high court fixed the date after hearing Dalmiya’s counsel S.B. Mukherjee. “The court has fixed the date of April 18 for the final hearing,” a source close to Dalmiya told IANS.
Dalmiya had filed an application against BCCI chief operating officer Shetty, president Pawar, secretary Niranjan Shah, vice-presidents Shashank Manohar and Chirayu Amin and treasurer N. Srinivasan, seeking permission to proceed criminally against them for committing perjury and forgery with an intention to mislead the court.
Dalmiya has alleged that the board had placed a forged document before Justice Indira Banerjee regarding the time application for the registration of an amendment to BCCI’s Clause-V of Rule 38.
Dalmiya also alleged that the board had incorrectly claimed that it had been permitted by the Tamil Nadu Societies Registration (TNSR) body to register the amendment at a later date.
Stating that an amendment must be registered with TNSR Act within three months, Dalmiya had claimed that the application was filed six years after the amendment was made in September 2000 and only after Dalmiya’s suspension.
The perjury case was filed under Section 340 of Criminal Procedure Code for allegedly providing false information to the court.
On July 20, 2007 the Calcutta High Court removed a ban on Dalmiya imposed by the BCCI and allowed him to contest elections.
Justice Indira Banerjee not only gave the ruling in favour of Dalmiya, but also observed that the rule under which he was expelled – and suspended from holding office for three years – was not registered and, as such, was illegal.
The judge had said there was no bar on Dalmiya contesting any elections of the BCCI or CAB. The same day Dalmiya filed the perjury case against BCCI.
