New Delhi : Vikas Yadav and Sukhdev Pehalwan, accused in the Nitish Katara murder case of 2002, approached a city court Monday, seeking to stay the upcoming judgement in the case after a sting operation by a tabloid.
The court is to pronounce the date of judgement in the case Wednesday.
The sting operation revealed that Ajay Katara, the main prosecution witness in the case, was allegedly a plant.
Moving an application before the court, Vikas and Sukhdev demanded that the content of the CD should be brought on record.
The sting operation disclosed that Ajay was not present in Ghaziabad, when the incident took place. It also reportedly showed his relationship with Neelam Katara (mother of Nitish Katara and the complainant in the case).
However, Additional Session Judge Ravindar Kaur said the court will pronounce its order on the case Wednesday and fix the date for the judgement.
On Sukhdev’s application, the order will be decided on Tuesday.
Moving an application under the Criminal Procedure Code (CrPC), Vikas Yadav said the video recording was “very important for arriving at a just decision in the case”.
“Since the trial is divided into two parts and the judgement in one case is pronounced, it is going to affect the case of the applicant immediately and the applicant will not be getting justice,” he said in his application.
Nitish Katara, son of a senior Indian Administrative Service (IAS) officer, was allegedly kidnapped and murdered by Vikas Yadav, his cousin Vishal Yadav and Sukhdev Yadav Feb 16-17 night, 2002.
They resented Nitish’s alleged relationship with Vikas’s sister Bharati.
Nitish’s body was later recovered from village Khurja in Bulandshahar in Uttar Pradesh.
