Aussie swimmer loses appeal to swim in Olympics

Melbourne : Disgraced Australian swim star Nick D’Arcy has lost his final bid to join the Olympic swimming team in Beijing.

D’Arcy appealed to the Court of Arbitration for Sport (CAS) against the Australian Olympic Committee’s decision to drop him from the team after his alleged involvement in a bar altercation in Sydney March 30.

CAS in Lausanne, Switzerland, rejected the national 200m butterfly record holder’s appeal to allow him to swim at the Olympics, according to a report in Herald Sun.

D’Arcy, 20, allegedly attacked former Commonwealth Games champion swimmer Simon Cowley in a Sydney nightclub in March, while he was celebrating his Olympic trials triumph.

Cowley, 27, was left with a broken jaw, broken nose, fractured eye socket, crushed cheekbone and also a fractured palate.

He had five titanium plates inserted into his face to repair the injuries. D’Arcy was charged with recklessly inflicting grievous bodily harm during the altercation. D’Arcy will face a Sydney local court again June 17.

AOC president John Coates last month removed D’Arcy from the Beijing team for bringing himself, the sport and the AOC into disrepute.

The CAS case, overseen by John Winneke QC, Justice Roger Gyles and Justice Henric Nicholas, had announced earlier this month that D’Arcy’s appeal proceedings would be confidential.

But both D’Arcy and the AOC agreed to make the final award public.
