New Delhi : Delhi High Court Thursday allowed a man to visit his 12-year-old son during winter and dussehra vacations, putting aside objections from the boy’s maternal grandparents.
Justice S.N. Dhingra directed Sarthak’s grandparents to allow him to remain with his father, Nagesh Tyagi, during the school’s winter vacation and the Dussehra break.
The court also directed the grandparents to change the boy’s title as of his father.
“The name of the child in school was kept as Sarthak Chopra (boy) as if he was sired by some Chopra and not by Nagesh Tyagi (father). This court ultimately directs the school, where the boy is studying, to (change) the name of the child to Sarthak Tyagi from Sarthak Chopra,” said the judge.
Dismissing the petition of Sarthak’s maternal grandfather Ram Murty Chopra, Justice Dhingra said: “The attitude of the grandparents had been to deprive Nagesh Tyagi the custody of his son and in this process to deprive the child of love and affection of his father.”
Tyagi had married Anupama in 1994 against the wishes of her family. In 1996, Sarthak was born and the boy was 13-month-old when Anupama committed suicide due to a family discord.
After the court’s intervention, the boy was under the custody of his maternal grandparents and the father was bearing all the expenses towards his maintenance.
While the court had also granted visiting rights to the father, the grandparents allegedly prevented Nagesh Tyagi from visiting the child stating that the boy was not getting along with him.
