A division bench of Justice Sanjay Kishan Kaul and Justice Ajit Bharihoke asked Gaurav Saini to approach the concerned court for justice as his plea, filed before the killing, for tracing her had lost its relevance.

The court’s remark came after Ghaziabad police submitted a status report and results of a polygraph test conducted on the family members of the victim of the alleged honour killing.

The court asked Saini to seek proper remedy against the accused in the appropriate court as the habeas corpus petition filed with it had lost its relevance.

It was after the court’s direction that the Sahibabad police had registered a case of murder and kidnapping against all the family members of the girl.

Police had later recovered the girl from her husband Gaurav Saini’s house in the national capital and arrested him. After getting her medically examined and recording her statement before a magistrate, police had handed over Monika to her mother and brother.

Saini moved the high court after being granted bail. On his petition, the court asked Sahibabad police to trace her and present her her before it.

However, on the very next day of the court direction the girl died and was cremated the following day without an autopsy.
