New Delhi: On his first day in office, Chief Justice S.H. Kapadia Wednesday spelt out his priority of tackling frivolous litigation.
Presiding over Court No. One, Chief Justice Kapadia made it clear that non-serious litigants could be slapped with costs for wasting the time of the court.
The message was candidly conveyed by the chief justice while dismissing a petition. He told counsel that a petition like this could attract costs.
In another case, the chief justice told counsel that he would not entertain any oral mentioning before the court.
He said if any urgent matter was to be mentioned, the lawyers should contact the mentioning section. “Thereafter, we will hear these in our chamber and pass orders,” he said.
Later, the apex court registrar issued a notice that in the court of the chief justice there would be no oral mentioning.
The decisions taken by Chief Justice Kapadia Wednesday about the conduct of proceedings are applicable to his court only. It will be for the presiding judges of the other 12 courts to decide if they want to emulate him.
