7/11 accused appeals for NIA probe; writes to PC from Mumbai Jail

Mumbai: Ehtesham Qutubuddin Siddiqui, an accused in the 7/11 Mumbai train blasts case, has written to Union Home Minister P Chidambaram urging him to order National Investigation Agency for a thorough probe into the case, as Mumbai ATS has falsely implicated innocents.

In his 3-page letter dated 6th October 2010, Siddiqui says he and his co-accused are innocent falsely implicated in the July 2006 Mumbai train blast case. “Hence it is kindly requested that please direct the National Investigation Agency (NIA) U/S 6(3) of National Investigation Agency Act 2008 for thorough investigation of 7/11 blast case and to unearth the false implication of innocent person in the said case by Anti-Terrorism Squad Mumbai,” reads the letter.

In the new letter, sent through the Superintendent, Mumbai Central Prison, the accused has pointed out the contradictions in the official documents about the 7/11 case.

SUBJECT: HUMBLE REQUEST U/S 6(3) OF NIA ACT 2008.

Respected Sir,

I am an innocent person, falsely implicated in 11th July 2006 Mumbai Train Blast case (known as 7/11 blast case) by Anti-Terrorism Squad Mumbai. In 7/11 blast case, the accused arrested in the year of 2006 all are innocent. All the evidences were falsely fabricated by investigation team lead by ATS chief Krish Pal Raghuvanshi and the evidence of our innocence were destroyed or hide by investigation agency.Currently, the trial of 7/11 blast case is started before MCOCA Special Court in Mumbai. This is the injustice with me and my co-accused that we are put on the trial of 7/11 blast case on false and fabricated evidences.

In September 2008, Mumbai Crime Branch arrested some person connected with Indian Mujahideen and crime branch chief Shri Rakesh Maria in joint press conference with ATS chief late Shri Hemant Karkare and Mumbai police commissioner Shri Hasan Gafoor claimed that some arrested person of Indian Mujahideen carried out the 7/11 blast in Mumbai local train in July 2006 and also group of Indian Mujahideen involved in several blast in the country between 2005 and 2008. But after the death of Shri Hemant Karkare, Shri Krish Pal Raghuvanshi again posted to Anti-Terrorism Squad chief and he washed out the claim of Mumbai Crime Branch and the claim of Mumbai Crime Branch was cool down.

Recently in June 2010, National Investigation Agency interrogated David Colemen Headley, arrested by American Agency in Chicago, in respect of 26/11 attack. In the said interrogation David Colemen Headley revealed that the plan of 7/11 blast was made in Karachi, Paskistan and he also mentioned the name of the conspirators. The name of conspirators according to David Headley are different to the name mentioned in the charge sheet of 7/11 blast case filed y Anti-Terrorism Squad Mumbai.

On 25/02/2010, Smt. Nirupama Rao, Foreign Secretary of India handed over the dossier to Pakistan Foreign Secretary, Shri Salman Bashir regarding the wanted accused of Terrorist activities in India. In the said dossier the name of the wanted accused of 7/11 blast case mentioned which are the same to the claim of Mumbai crime branch in September 2008 that the 7/11 blast carried out by member of Indian Mujahideen, and the name of the wanted accused in the said dossier is different to the name of the wanted accused mentioned in 7/11 blast case charge sheet filed by Anti-Terrorism Squad Mumbai in November 2006.

Hence, in view of the events mentioned above namely claim of Mumbai Crime Branch in September 2008, revelations by David Colemen Headley in June 2010 when interrogated by National Investigation Agency of India and according to the dossier handed over to Pakistan on 25/02/2010 through investigation of 7/11 blast case is required to unearth about the false implication of innocent people by investigation team lead by Krish Pal Raghuvanshi and to caught the real culprits behind the 7/11 blast.

That the charge sheet contained many loopholes and if any one perused the charge sheet, easily understood that the story of the Anti-Terrorism Squad is false, fabricated and the all arrested accused are innocent.

Hence it is kindly requested that please direct the National Investigation Agency (NIA) U/S 6(3) of National Investigation Agency Act 2008 for thorough investigation of 7/11 blast case and to unearth the false implication of innocent person in the said case by Anti-Terrorism Squad Mumbai, and I am an innocent person falsely implicated in 7/11 blast case and is in custody since July 2006, therefore kindly direct the appropriate Authority to discharge me and other persons U/S 169 of criminal procedure code from 7/11 blast case pending before MCOCA Court, City Session Court, Mumbai. The 7/11 blast case registered in Mumbai City Session Court as MCOCA Spl. case No. 21/2006.
