Kochi: The Kerala High Court issued notices to Kanthapuram AP Abubacker Musalyar and Kerala govt over a petition filed by a Kozhikode native Muslim named UC Abu, accusing the religious leader of making use of the religious sentiments for his spiritual business in the name of Holy Hair [Sha’ere Mubarak]. The petitioner accused Kerala govt of not taking appropriate actions against this spiritual business and considering this petition, the High Court ordered to issue notices to the Chief Secretary and Home Secretary of the state govt.
The petitioner had earlier sent a letter to the Union Ministry demanding a probe into the Holy Hair issue. The Union Ministry then asked the Kerala govt to carry out an investigation. The petitioner approached the court as he found that the state govt was reluctant in carrying out the investigation.
The petition states that there is no evidence to prove that the ‘hair’ belongs to the Prophet, and so the intensions are purely to market the religious sentiments to extract easy money out of the people’s ignorance. The petition says that the issue so comes under the purview of public interest and should be checked by law.
The petitioner had earlier too made a petition on this regard but the court recommended to resubmit it as a PIL. It was since then Abu submitted a PIL on this regard through Advocate VDK Mohanan. It was based on this petition the Division Bench including acting Chief Justice Manjula Chellur and Justice AM Shafeek issued notices to both AP Abubacker Musalyar and the Kerala govt.
