New Delhi: In yet another shocking incident of corporal punishments in the government schools, in Delhi a 11 year old boy was beaten up black and blue by the teacher on the suspicion of breaking window pane. On April 28th, 2012 about 03:30 pm Fardeen, a class fifth student of MCD Primary School, H-II (Second Shift) Block sustained eye injury and bruises all over his body. Child was beaten up by his teacher Ramjit yadav by fists and kicks and even by cane, and locked inside the classroom for nearly 3 hours states petition filed by social jurist Ashok Agarwal on behalf of the boy’s family in National Human Rights Commission.
The petition also alleged that police even after repeated requests from father is not registering complain against the teacher and even Additional Director of Education, MCD Kanwar Singh is not taking any action despite all the facts brought to his notice.
Speaking to TCN Advocate Ashok Agarwal said, “It is case of poor verses rich, the boy belongs to a poor family background and govt teachers lobby is strong in Delhi school and even authorities are supporting the cruel teacher. That is why police is reluctant to file a case even after seeing the medical certificate and knowing the facts. It is not the first type of case where poor boy was beaten but the tragedy is before the case could become open authorities try to settle the dispute by harassing poor parents, in the last 15 years there have been several cases in government schools where teachers indulge in corporal punishments but no government teacher till now has been suspended. We believe NHRC will take a though decision and lay a good precedent.”
The father of the boy Navisher Mallick took him to Babu Jagjivan Ram Memorial Hospital in the evening on the same day, where he got medical treatment and MLC bearing No. 40834 (E NO. 42575).
Navisher Mallick father of the child said, “School principal refused to take action against the teacher, the principal has challenged us to do whatever we can. My child has suffered serious eye injury, severe pain and bruises all over his body. I tried to lodge a complaint in the evening at the Jahangirpuri police station, but the police showed it’s reluctance and then finally file the complaint, but completely refused to open a case.”
Advocate Ashok Agarwal said, that fundamental rights of the boy under article 21 and 21A is being violated, and even he was forcefully confined illegally for 3 hours which is punishable under IPC. He even said that the behavior of the school teacher and administration is against the provisions of Right to Education Act.
