Aarushi case: Trial in sessions court from Friday

Ghaziabad : A magistrate here sent the Aarushi Talwar case – involving the 2008 twin murders of the teenager and her domestic help Hemraj – to a sessions court for trial starting Friday.

Aarushi’s parents – dentists Rajesh and Nupur Talwar – are both accused in the case.

Central Bureau of Investigation (CBI) Special Magistrate Preeti Singh Wednesday dismissed Nupur Talwar’s plea and said that the Supreme Court wanted expeditious trial hence the case was being referred to the sessions court.

The case could not be sent to the sessions court earlier as the lawyers of Aarushi’s mother Nupur Talwar submitted an application seeking some documents from the probe agency.

The dentist couple’s 14-year-old daughter Aarushi was found dead inside their Noida residence in May 2008 with her throat slit. The body of the Talwars’ domestic servant Hemraj, initially a suspect in the case, was recovered from the terrace a day later.

On Wednesday, the CBI submitted that the application filed by Nupur Talwar seeking some documents was aimed at delaying the trial.

The probe agency said that the application should be disposed of as the documents had been supplied.

Nupur Talwar’s counsel Vijay Pal Singh Rathi said the accused had every right to obtain each paper of the case diary.

The documents from case diary from page 159-951 and 4,815-4,829 pertaining to the statements of witnesses Raj Kumar and Krishna were needed for Nupur Talwar’s defence, he said.

Statements of 124 witnesses were recorded while copies of only 96 witnesses were provided to her, he said.

After hearing the arguments, the special magistrate dismissed the defence plea and referred the case to a sessions court to initiate trial.
