Court upholds denial of information on IRS official

New Delhi : The Delhi High Court has upheld the decision of the Union Public Service Commission (UPSC) not to share information related to disciplinary proceedings initiated against an Indian Revenue Service officer.

A division bench of Chief Justice D. Murugesan and Justice Rajiv Sahai Endlaw Tuesday set aside orders of another judge and the Central Information Commission (CIC) that directed the UPSC to provide information related to the disciplinary proceedings initiated against a 1974 batch IRS officer G.S. Narang to RTI applicant R.K. Jain.

The bench relied upon a Supreme Court verdict that held that “information on disciplinary proceeding against an officer is personal in nature and the RTI Act exempts the department from disclosure of such details”.

It also accepted the UPSC’s argument that the commission could not conduct any disciplinary proceedings against the IRS officer but could only give its opinion to the central government.
