New Delhi : The Delhi High Court Friday suspended the extradition of a fugitive Bangladeshi national, wanted in a 23 year-old murder case in the US.
Justice G.P. Mittal, suspending the extradition of Mehfuz Huq, also issued notice to the home ministry, external affairs ministry and the Tihar Jail authorities for March 13.
The court suspended the Jan 9 order of additional chief metropolitan magistrate (ACMM) to send Huq to the US to stand trial in the murder case registered in 1989.
“Issue notice to centre… The petitioner shall not be conveyed out of India till the next date of hearing,” the order said.
Following the lower court’s’s order, Tihar Jail authorities were to hand Huq over to US marshals Friday.
Delhi Police had arrested Huq from the IGI Airport Feb 10, 2011, when he arrived with some schoolchildren from Dhaka for a tournament here, on the basis of an Interpol ‘Red Corner” notice.
As per the petition, Huq was required to face trial in a US court for the 1989 murder of 19-year-old Todd Kelly as he opposed his girlfriend’s intimacy with Kelly.
The plea alleged that Huq after murdering Kelly Aug 9, 1989, fled to Bangladesh and started working as a teacher with a school run by the US Embassy.
The plea filed through advocates Jayant K. Sud and Vishal Dabas, said that the order of ACMM was based on the documents which were not sufficient to extradite him.
