New Delhi: A court here has issued summons against a woman for allegedly cheating her husband and causing a miscarriage before marrying the man.
Additional Sessions Judge Ashutosh Kumar said that prima facie, the miscarriage was caused by the woman without the consent of her husband, and as such an offence under section 312 of the Indian Penal Code was committed by her.
The court said the woman knew about her pregnancy before her marriage and she had not disclosed this fact to her husband before tying the knot and had thereby deceived him.
“Consequently, the acts of the woman clearly fall under the definition of cheating,” the court said in the order made available Tuesday.
The court was hearing a revision petition filed by the man, a resident of Najafgarh area of west Delhi, seeking legal action against her wife for cheating him.
The court set aside a magisterial court order and asked the woman to appear before the concerned magistrate.
The court directed that a copy of order be sent to the magisterial court and fixed the matter for April 1 for further proceedings.
The man alleged that his wife admitted that she was having an affair with someone else prior to their marriage.
He said he got married to the woman in April 2012 and was not allowed to talk or meet her before marriage.
