New Delhi : A city court will hear Monday a case between the country’s two top investigating agencies with each blaming the other for their role in framing two men as terrorists of the Al-Badr group.
The court is likely to hear a Central Bureau of Investigation (CBI) inspector’s plea to provide him protection after he allegedly received threats from an inspector of Delhi Police’s elite anti-terror unit, Special Cell.
The CBI in its closure report last year had submitted that the two alleged Al-Badr terrorists are innocent and were wrongly framed.
In an application filed before Additional Sessions Judge S.K. Gautam, CBI Inspector Santosh Kumar alleged that he was threatened by Special Cell Inspector Vinay Tyagi when he came to the Tis Hazari court for hearing in the matter Dec 15.
He claimed before the court that the Cell’s officers were threatening him as he had exposed them in a case of framing two people as terrorists of Al-Badr group.
“It is humbly prayed to the court to protect the safety and security of the applicant by giving proper direction,” his application said.
Kumar alleged that the police officer had warned him of serious consequences claiming that he had faced “many such CBI inquiries”. He further expressed his determination to take the matter even to the apex court, if need be.
He alleged that Tyagi had told him that it is only due to such persons that incidents like the Mumbai terror attacks take place, warning him to be mindful of his safety, the application alleged.
Tyagi along with two other officials had been accused by the CBI of framing Mohammed Moarif Qamar and Irshad Ali as militants of Al-Badr, whereas the CBI had come to a conclusion that the two were working as police informers.
They were allegedly penalised after they did not go to Kashmir as directed by the Special Cell sleuths and an official of the Intelligence Bureau.
The three Special Cell officials — Vinay Tyagi, Ravinder Tyagi and Subash Vats — were questioned by the CBI, which held a probe into the case following a direction by the Delhi High Court.
The Special Cell had arrested Ali and Qamar on Feb 9, 2006, from the G.T. Karnal Road bus terminal. The police had claimed that pistols, RDX, detonators and other munitions had been recovered from them.
