While disposing a public suit filed by a voluntary group 'Hum Aap Ke', judges T.S. Thakur and S.N. Agrawal ruled: "According to a government notification of Dec 31, 1970, Delhi Waqf Board was the only authority to manage the Nizamuddin dargah, Amir Khusro dargah and other monuments."

The court also directed a Delhi government official, who earlier had been appointed by the court to manage the donations to the Nizamuddin dargah, to hand over his responsibilities to the Waqf Board within seven days.

On a plea by counsel Nijim Waziri, the court granted Waqf Board the liberty to appoint a former high court judge, Justice Mohammed Shamin, as head of its committee to look after the management of the dargah, which receives millions of rupees as donations from devotees every year.

The petitioner claimed that millions of rupees of donations were being usurped by some who claimed to be descendants of Sufi saint Nizamuddin.
