HC reserves order on whip on constitution amendment bills

New Delhi : The Delhi High Court Wednesday reserved its order on a plea seeking directions to restrain political parties, including the Congress and the BJP, from issuing whips to their parliamentarians on issues of constitutional amendment.

A division bench of Chief Justice D. Murugesan and Justice V.K. Jain after hearing the arguments of petitioner registered society Samta Andolan Samiti, the central government and other parties reserved the order.

The petition, filed through advocate M.L. Lahoty, said: “The action of the political parties of issuing the party whip in the matters of constitutional amendment, is against the provisions of the constitution.”

“The Provisions of X Schedule of the constitution can be exercised by the political parties for issuance of a whip/direction only for the purpose of vote on confidence motion,” said the petitioner.

It added that the provision did not empower a political party to issue a whip on a matter involving constitutional amendment.
