N.D. Tiwari’s mediation plea dismissed in paternity suit

New Delhi : The Delhi High Court Friday dismissed a plea by veteran Congress leader N.D. Tiwari seeking mediation in a paternity suit filed by a man for Tiwari to be declared his biological father.

Justice Rajiv Sahai Endlaw dismissed Tiwari’s plea after 32-year-old Rohit Shekhar, who claims that the 90-year-old Tiwari is his biological father, and his mother Ujjwala Sharma refused to mediate saying they would contest the case.

Taking note of the contentions, the court fixed the case for final hearing April 21.

Tiwari, who has been fighting the legal battle from 2008, had moved an application saying he wants to explore the possibility of “amicable settlement” through mediation in the interest of justice.

On Feb 20, the local commissioner appointed by the court to record evidence, had closed the right to lead the evidence of Tiwari after he failed to appear for cross-examination despite his last opportunity.

Tiwari has been refuting the claim of Shekhar.

The high court July 27, 2012, read out a DNA report in the case, according to which Tiwari was shown as Shekhar’s biological father.
