New Delhi : The Supreme Court Monday said it had permitted construction of a third floor only in residential areas and not in commercial localities of the national capital.
A Bench of Justice Arijit Pasayat and Justice P. Sathasivam said this while clarifying its earlier March 14 order which permitted construction of an additional third floor.
The bench Monday said the order was restricted only to residential localities.
The apex court made the clarification on an application by Municipal Corporation of Delhi seeking to ascertain whether construction of additional third floor was permissible in commercial areas.
MCD counsel Sanjiv Sen sought the clarification saying it was essential as the civic body officials were confused about the applicability of the bench’s earlier direction.
“There is no need for clarification. Your officials deal on case-to-case basis and suitcase-to-suitcase basis,” the bench remarked sarcastically, disposing off the MCD application.
In a much-needed relief to the living space-starved national capital, the bench on March 14 had allowed addition of a third floor and several dwelling units in buildings on legally developed residential plots.
Besides allowing four dwelling units in the buildings on plots between 50 to 250 square metres, the bench had also increased the number of dwelling units up to a maximum of ten in buildings made on plots of 1000 square metre and above.
