New Delhi : The Delhi High Court Friday refused to reinstate a senior government auditor who was dismissed from service after his stenographer accused him of sexually harassing her in office eight years ago.
Dismissing a petition filed by Y.R. Midha, former Principal Director of Audit (Scientific Departments) with the Comptroller and Auditor General (CAG), a division bench of Justices Mukul Mudgal and Manmohan said: “Having gone through the evidence and the complaint, besides the attendant circumstances, we are satisfied that the finding of the complaint committee is unassailable”.
The bench upheld the Central Administrative Tribunal’s (CAT) July 2003 order rejecting Midha’s petition for reinstatement in the service.
The Bench rejected Midha’s contention that the complaint was lodged by his stenographer at the instance of a senior colleague with whom he had a heated argument a few days before the complaint against him was lodged.
In August 1999, Midha’s stenographer had sent two different complaints to the CAG accusing Midha of sexually harassing her in office.
Following the complaints, a departmental enquiry was conducted against Midha and it was recommended that he be dismissed from service.
