HC stays proceedings in flag case against Sania

Justice Rakesh Saksena of Madhya Pradesh High Court have stayed proceedings against Sania Mirza in a case that alleged that she disrespected the national flag.

Justice Rakesh Saksena of Madhya Pradesh High Court’s principal seat at Jabalpur was directed by the Chief Justice A K Patnaik to take up this case.

The court took suo-moto notice of the case filed in the court of Chief Judicial Magistrate (CJM) Ajay Shrivastava against tennis player Sania Mirza for allegedly disrespecting the Indian flag.

Justice Saksena stayed proceedings against Sania and issued a show-cause notice to the petitioner asking why this case should not be quashed.

The ruling noted that the incident referred to in the case took place in Perth, Australia, therefore the case cannot be registered without the permission of the Central Government. All details of the case is to be transferred to the High Court from CJM’ court.

Ms. Mirza was pictured sitting in front of the Indian flag with her feet pointing towards the flag. People who were there pointed that angle of the picture makes it look like she is close to the flag but in fact there was much distance between her and the flag.
