New Delhi : Industrialist Ashok Todi, who is fearing arrest in the Rizwanur Rehman suicide case, Friday moved the Supreme Court challenging the non-bailable arrest warrant against him and two others for their failure to appear before the Kolkata trial court.
A Bench headed by Chief Justice K. G. Balakrishnan posted the hearing to Nov 10 after Todi’s counsel said his surrender would lead to his arrest and therefore the petition should be heard on an urgent basis.
Senior advocate Harish Salve, appearing for Todi, who has been chargesheeted for alleged abetment of suicide of his son-in-law Rehman, said that despite the Oct 13 order of the apex court there was no protection to the industrialist.
The apex court had earlier said trial in the case would not commence till the Calcutta High Court decides a petition filed by Todi challenging CBI’s decision to chargesheet him in the case.
Todi, along with six others, was chargesheeted by the CBI for alleged abetment of Rizwanur’s suicide last year.
A Metropolitan Magistrate in Kolkata had asked the accused to appear before it on Oct 27 but they had failed to abide by the order, causing the court to issue non-bailable warrants against them.
Rizwanur’s body was found on railway tracks Sep 21, 2007. He had married Todi’s daughter Priyanka Aug 18 last year.
Besides Ashok Todi and his brother, the chargesheet names the then deputy commissioner of Kolkata Police Ajoy Kumar, then assistant commissioner of police Sukanti Chakraborty, sub-inspector Krishnendu Das and family friend of the victim S.M. Mohiuddin alias Pappu.
