Filing their objections, police said the Central Bureau of Investigation (CBI) had done only re-investigation as per the Delhi High Court order but the matter should be investigated again.

Taking the objections on record, Additional Sessions Judge S.K. Gautam asked Delhi Police to file a reply to the other application in which the immediate release of the two people was demanded from Tihar jail as the closure report by the CBI found them innocent.

Counsel for Mohammed Moarif Qamar and Irshad Ali had earlier filed the application saying their incarceration was against the constitutional right to life.

The application said they cannot be jailed as nothing incriminating was found against them.

The court also asked the defence counsel to submit their reply to the Delhi Police submissions by Jan 13, the next date of hearing.

The Delhi Police Special Cell arrested the two people from the G.T. Karnal Road in north Delhi with the help of an Intelligence Bureau official in February 2006. But the CBI found nothing adverse against them and termed them as innocent in its report.
