Gulberg massacre: Plea to analyse CD rejected

Gandhinagar : A special court trying the 2002 Gulberg Society massacre case Tuesday rejected an application seeking directions to the apex court-appointed Special Investigation Team to further probe details of a CD containing call records of politicians, police and some accused in the case during the riots.

Special judge B.J. Dhandha rejected the plea moved by some of the victims of the case, stating that the SIT was still investigating the cases and was going to place its report before the Supreme Court.

Hence there was no need to entertain the application, he added.

Advocate S.M. Vora, representing the victims, had argued that the SIT has placed on record call details of the accused in the case, but has not put on record of the court the phone call details of the other people who were in touch with the accused in the case.

These other persons named in the application include Indian Administrative Service (IAS) officer Anil Mukim, Tanmay Mehta and Sanjay Bhavsar of Chief Minister Narendra Modi’s office (CMO), the then state police chief K.Chakravarthi, former minister of state for home Gordhan Zadafia and others.

Vora had sought directions for the SIT to place on record phone call details of these 27 people contained in the CD prepared by Indian Police Service (IPS) officer Rahul Sharma in 2002.

He had said that SIT should record statements of these people, verify their phone numbers, cross examine them as to with whom they had talked on phone and place those statements on record of the court.

Opposing the plea, public prosecutor R.C. Kodekar said that phone call details of the accused concerned have been placed on record in the court.

He argued that further investigation by the SIT was on in the case and the agency was to produce the report in the Supreme Court, and therefore, no order should be passed in relation to other people who are not accused in the present case, he added.

Agreeing with Kodekar, the court rejected Vora’s application.

The court also rejected another application of some of the victims seeking inclusion of retired IPS officer M.K. Tandon and police officer N.D. Parmar as accused in the Gulburg case, saying since Tandon and Parmar are being investigated by the SIT, there was no need to pass any order on this.
