Kochi: The central Home Ministry permitted the National Investigation Agency to prosecute the accused in the Kashmir recruitment case. The accused will be charged under various sections of the UAPA and IPC. Among the 24 accused, four have reportedly died in encounter with army in Kashmir. The NIA is supposed to submit the chargesheet at the special CBI court in Kochi soon.
According to reports, the prime accused in the case is Abdul Jaleel, native of Edakkad in Kannur, and the second accused is Thadiyantavide Naseer, who is the prime accused in several other cases also. The 24th accused Abdul Rahman Wali is reportedly a Pakistan citizen. Three accused in the case are accused in other bomb blast cases also elsewhere in the country.
The case came up when it was known that four Keralites were killed in encounter with the army in Kashmir. A case was registered at the Edakkad police station in Kannur accusing that a secret meeting was held in 2008 August in Kannur and many youth recruited to Kashmir. The police submitted chargesheet in January 2009. Four months later, the case was handed over to the NIA owing to the graveness of the case.
The NIA submitted the fingerprint documents confirming the death of two Keralites – Abdul Raheem of Malappuram and Muhammed Fayas of Kannur – last month. The agency had earlier itself informed the court that the death of the men had been officially confirmed but had not submitted any proof for it. The death of two others – Varghese Joseph alias Muhammed Yaseen of Ernakulam and Muhammed Fayis of Kannur – were not confirmed in scientific tests, so the court had confirmed the death by a trial of their relatives. The NIA was not able to produce for a long time any document such as the death certificate, autopsy report etc confirming the death of the four accused. And the others accused had questioned the very version of the death of four Keralites in Kashmir.
The NIA has submitted chargesheets in all the other cases it has taken over in Kerala – 2006 Kozhikode twin blasts case, 2005 Kalamassery bus-burning case, 2006 Panayikkulam SIMI case and 2007 Vagamon SIMI camp case. Thadiyantavide Naseer is the prime accused in the first two cases.
