Maudany’s bail plea postponed for third time

Bengaluru: The Karnataka High Court yesterday postponed the hearing of the bail plea submitted by Abdunnasir Maudany, arrested in connection with the 2008 Bengaluru blast case, for the third time. The plea will be considered again on January 16. This is the second time that the hearing is postponed on the request of the prosecution.

The Additional State Public Prosecutor Adv PM Navas requested for two weeks’ time when the plea was considered on Wednesday. Maudany’s consul Adv P Usman opposed it. He requested that the court ask the prosecution to submit its defence immediately so that the hearing on the plea may be carried out soon. Then, the judge V Jagannathan allowed 10 days’ time for the prosecution. He told the prosecution not to ask for time again and that it would be the last postponement.

Maudany submitted the bail plea on December 13, 2010. The Court sent notice to the Karnataka government on December 15 asking to inform its response on the matter in a week. The plea was considered on the day and the court gave a week’s time for the prosecution to present its part. However, since the court was on holiday from December 17 onwards, the case was again considered on January 3. The prosecution asked for two days’ time when the plea was considered on January 3, hence the postponement to January 5.

PDP chairman Abdunnasir Maudany was arrested on August 17, 2010 by the Karnataka police from Kerala for his alleged role in the 2008 Bengaluru blast. Maudany was the 31st accused in the case and charged with conspiracy. Maudany was in police custody for 10 days and then remanded to judicial custody which has been extended till date.

Maudany submitted the bail plea stating that he was innocent of the charges and that he was falsely implicated in the case. The plea reportedly says that since the chargesheet has been submitted and the case transferred to trial court, Maudany’s custody was no longer necessary. Also, the police have not been able to find any evidence against Maudany even after interrogating him for months. Maudany was earlier denied anticipatory bail in the case by lower courts and the Karnataka High Court, after which came his arrest in August.
