New Delhi : The Delhi High Court Friday imposed a cost of Rs.1 lakh on Institute of Human Behaviour and Allied Sciences (IHBAS) over grant of admission to an undeserving doctor in super-speciality Diploma of National Board (DNB) course.
Pulling up the IBHAS, Justice Kailash Gambhir said: “IHBAS has clearly acted not only in the breach of the policy guidelines of the National Board of Examinations (NBE) but also caused unnecessary harassment and agony to the petitioner making him believe that his selection in the DNB programme was legal.”
The court was hearing the petition filed by a resident doctor, Hari Nath Yadav, who was given admission in DNB (Neurology) course for three years in February 2009 by the selection committee of IHBAS on the basis of written test and interview.
Over his selection, he had started attending the DNB programme and he was also allotted hostel accomodation.
After three months, Yadav applied for registration from the NBE but it was rejected by the board in May 2009 on the ground that he was not CET-DNB qualified candidate and not eligible for admission to the course.
After this, Yadav approached the high court, which upheld the decision of the NBE but directed the hospital to pay him the cost for harassment.
The court asked the institute to pay the amount to Yadav within a month’s time.
“The cost of Rs.1 lakh shall be recovered by the administrative head of the institute from the officials responsible for publication of the flawed advertisement,” the court said and sought a compliance report within two months.
“According to NBE, the eligibility criteria for granting admission in the DNB programme is qualifying the entrance test and such illegal act has caused anguish, pain and torture to the petitioner,” Justice Gambhir said.
