Central Bureau of Investigation (CBI) Special Judge Talwant Singh deferred the order on framing of charges against central excise Commissioner A.K. Srivastava, central excise Superintendent Lallan Ojha and middleman Hemant Gandhi and two businessmen Dilip Aggarwal and Anand Aggarwal.

The probe agency and the accused have already concluded their arguments on charge. The five accused has denied the charges levelled against them.

The CBI in February filed a chargesheet against the accused and booked them under charges dealing with corruption and criminal conspiracy.

Ojha, along with a team of officials of central excise, raided at the warehouse of Dilip Aggarwal and Anand Aggarwal and negotiated a deal for illegal gratification, the probe agency said.

The CBI arrested the two excise officials and the middleman in January for allegedly receiving illegal gratification of Rs.60 lakh from the two businessman to shield them in an excise law violation case.

Srivastava, Ojha and Gandhi are presently lodged in Tihar Jail and the two businessmen are out on bail.
