New Delhi : Delhi Police Thursday told a city court that they will soon move the Supreme Court against a high court order asking them to consider the Central Bureau of Investigation (CBI) closure report against two alleged Al-Badr militants.
Delhi police Special Cell counsel told Additional Sessions Judge S.K. Gautam that it has received the state government’s approval to file an appeal against the Aug 28 order of the Delhi High Court.
The high court had directed the trial court to decide the case by considering the CBI report seeking discharge of the two accused.
Irshad Ali and Moarif Qamar were arrested here in 2006 on suspicion of being Al-Badr militants in alleged possession of arms and ammunition.
The CBI, in its closure report in November last year, said the two people were framed by Delhi Police. The investigating agency demanded a thorough probe against three police officials, Vinay Tyagi, Ravinder Tyagi and Subhash Vats, for allegedly lying on oath as well as planting fake evidence, including arms and ammunitions, on the duo.
A counsel for one of three police officers who were sought to be tried by CBI for allegedly implicating the two men as Al-Badr militants, filed an application in the court saying he had already made an appeal in the apex court against the high court’s order allowing his prosecution.
Following the hearing, the judge allowed the CBI’s plea to adjourn the matter and posted the case for Oct 27.
