Chen was found smoking near a ventilation shaft in Hongkou Football Stadium Station March 23, the Shanghai Daily reported Friday.

Police said his behaviour “put subway safety in jeopardy”.

A cleaner saw Chen smoking and when police arrived, he threw away the cigarette butt.

Chen, 49, admitted to the police he knew that smoking was banned in Metro stations and on subway trains.

Metro stations are now listed as a top level smoking-free zone.

Smoking has been prohibited in public places since the ban came into effect in March 2010.

In the past 12 months, five individuals have been punished for breaking the smoking ban.
