Apex court refuses to interfere with Sajjan bail

New Delhi: The Supreme Court Monday refused to interfere with a Delhi High Court order granting bail to former Congress MP Sajjan Kumar facing prosecution for allegedly instigating anti-Sikh riots after the killing of the then Prime Minister Indira Gandhi in 1984.

A bench headed by Justice P. Sathasivam and Justice H.L. Dattu refused to interfere with the high court order on bail to Sajjan Kumar, and dismissed a plea by one of the anti-Sikh riot victims, Jagdish Kaur, seeking cancellation of the bail.

The bench said: “We do not underestimate the feelings of the victims,” but “the high court has given a reasoned order.”

The bench said that the alleged incident involving Kumar’s role in instigating the riotous mob, leading to the killings of Kaur’s husband and sons in west Delhi area, was 25 years old and there was little chance of Kumar tampering with the evidence or influencing the witnesses now.

The bench observed that in the eventuality of the former MP trying to influence witnesses, the CBI can approach the trial court for cancelling his bail.

The apex court noted that the background of the case is peculiar and considering all the circumstances, there is nothing wrong in grant of anticipatory bail to Kumar.

The court dismissed the petitions filed by families of the riot victims.

Sajjan Kumar was granted bail by the Delhi High Court Feb 26 in two cases registered against him for the 1984 riots.
