Court allows elderly man to evict son from house

New Delhi : A Delhi court has restrained a man from subletting a portion of a house owned by his elderly father and allowed the property owner to take possession of the dwelling unit from his son.

The court passed a decree of possession in favour of Devi Dayal Sharma, a resident of Yamuna Vihar in east Delhi.

Sharma moved court seeking direction to his son, Rohit, and daughter-in-law, Ritu, to return the flat’s possession to him.

The elderly also sought a restraint order to prevent his son from subletting a portion of the property.

Additional Senior Civil Judge Raj Kumar, in a recent order, said: “I hereby pass a decree of permanent injunction against the defendants restraining them and their agent etc. from subletting, assigning and parting with the possession of the suit property or creating any third party interest in the suit property forcibly and illegally.”

Sharma pleaded that he was the rightful owner of the house in Yamuna Vihar.

He alleged his son got married in November 2008 and he allowed the couple to live on the first floor in the house as lessees.

Sharma said that the couple had assured him that they would not cause any problem for him and his family but they harassed and humiliated him after which he sent them a legal notice in October 2010 terminating their lease.
